A: This is a two step process. First, a Notice of Disagreement must be submitted. There is no specific form required. However, the Notice of Disagreement must plainly state that the veteran disagrees with the denial of benefits. Upon receipt of a Notice of Disagreement, the VA must prepare a statement of the case.
Second, the veteran must timely file a VA Form 9. The VA form 9 must be filed either within 60 days of the recept of the statement of the case from the VA or within one year of the date of the written denial of the claim from the VA, whichever is later.
