
Last year Congress considered a bill that would make car manufacturers more accountable to consumers for manufacturing defects. The bill, known as the Motor Vehicle Safety Act of 2010, had a main goal of improving vehicle safety, something much needed in the wake of the Toyota recalls. Yet despite the fact that millions of Americans were affected by these recalls, Congress failed to pass the act.
Had the act passed, it would have strengthened vehicle safety standards, which have been getting stronger thanks to litigation. Unfortunately, limited government enforcement tools have held some agencies back from forcing the automobile industry to improve car safety.
The act would have also made vehicle safety records more readily available to the public, would have increased the fine cap the government could charge a manufacturer for liability from $16.375 million to $300 million, and would have given the National Highway Traffic Safety Administration (NHTSA) more authority over implementing vehicle safety standards.
Some believe that the bill failed because of the strength of the automobile industry's lobbying efforts. But one thing is clear--if the United States wants to prevent another Toyota recall disaster, Congress will need to strengthen the enforcement powers of NHTSA.
American consumers demand the best in safety, and there is no reason why another consumer has to die because of a defective part on a car.
