Xarelto Lawsuits – EXCITING NEWS

Mar. 25 2019  – A settlement agreement has been reached between the manufacturers of Xarelto and the plaintiffs who claimed injuries from Xarelto use.  The gross settlement numbers are known, but the recoveries that will be allocated to individual plaintiffs are not.

The settlement includes all filed and unfiled cases.  Xarelto manufacturers have agreed to pay $775,000,000 to settle what they believe to be approximately 25,000 claims.  We do not yet know the terms of the proposed settlement, and we do not know the timing of the payments or the case review process.

There is a very limited time, three days, for new cases to be submitted (March 28th) in accordance with the settlement. If you have been injured you must act quickly to be considered.

What is Xarelto?

XareltoXarelto (rivaroxaban) is a blood-thinning drug (anticoagulant) that is widely prescribed to patients to treat blood clots, deep vein thrombosis (DVT), and pulmonary embolisms. It has been sold by Bayer HealthCare and Janssen Pharmaceuticals since 2011. Xarelto can cause serious internal bleeding injuries. It has no reversal agent.

Xarelto Background

Since 1950, the blood thinner warfarin has been the main blood thinner available to patients. A new generation of blood thinners, including Eliquis, Pradaxa and Xarelto, are now marketed as an alternative to warfarin. Manufacturers claim that Xarelto is much more convenient to take than warfarin, but it is also very dangerous, and this has been downplayed.

These FDA-approved blood thinners have no antidote available to reverse bleeding once it had started.

This means that if you are taking Xarelto and you begin to bleed internally, there is no way for doctors to stop the bleeding, and no way for them to remove the drug from your system. If you take Xarelto and you are involved in some sort of accident or you have to undergo a surgery, doctors may have a tough time stopping the bleeding. Victims are now filing lawsuits claiming that the manufacturer did not properly warn the medical community and the public about the bleeding risks that can cause serious injury and even death.

Marketing for Profit, Not Public Safety

Despite the fact that they face litigation concerning the safety of Xarelto, heavy marketing of the drug continues, sales appear to be strong, and partners Bayer and J&J are making a healthy profit. Sales continue to climb, and doctors continue to prescribe the drug, although some are fully aware of the risks. Kay Van Wey is an experienced attorney currently accepting Xarelto cases, and she can help you receive the compensation you deserve if you have suffered or lost a loved as a result of using Xarelto. You could possibly receive compensation for:

  • Medical expenses
  • Financial hardship (inability to work because of injuries)
  • Funeral expenses (if a loved one has lost his or her life)
  • Loss of consortium (when Xarelto causes fatal injuries)

XareltoMost importantly, you can assist in holding Janssen Pharmaceuticals and Johnson & Johnson responsible for exercising negligence for the manufacturing and marketing of a dangerous drug.

Xarelto Celebrity Endorsements

Xarelto’s website home page and latest commercial state that the drug is the “#1 Prescribed Blood Thinner in its Class!“. The ad is accompanied by popular celebrities who endorse the drug (Kevin Nealon, Arnold Palmer, Brian Vicker). The truth, however, is that Xarelto carries serious risks as well.

Although the commercials and ads claim the convenience of taking Xarelto, risks are downplayed. Celebrities will say taking Xarelto allows you to live your life to the fullest (on the golf course, or drinking an Arnold Palmer), but they hardly mention the fact that Xarelto has no antidote. The lack of a reversal agent for Xarelto places patients at risk for serious uncontrollable bleeding events.

To date there have been approximately 3,000 lawsuits filed by those who claim they never were told about the risks (failure to warn) and, as a result, suffered serious injuries and even death. It is predicted that this number will continue to rise, as more and more victims come forward, and as more unaware patients ingest this drug that has no antidote to stop bleeding if it should occur.

At this time there has been no recall of Xarelto related to internal bleeding. The investigation into the drug, however, is in its early stages, and it often takes many years, thousands of attorney hours, and millions of dollars spent before the facts come out that will lead to a recall.

Remember: Never stop taking your medication without first consulting with your doctor!
