Jury Awards $4.5M In Medical Malpractice Suit

A Colin County jury has awarded more than $4.5 million to the victim of a medical malpractice lawsuit against Baylor Heart Hospital Plano. This award has been named one of the largest medical malpractice verdicts in Collin County history.

In 2017, Bijan Pajouh was scheduled for an elective heart catheterization procedure to explore the arteries around his heart. This is a routine procedure that is performed on an elective basis in hospitals around the country every day. However, prior to this elective procedure, Bijan’s blood sugar was recognized to be in a critically high range. If not addressed and controlled, critically elevated blood can have disastrous consequences.

Instead of health care providers at Baylor Heart Hospital waiting to ensure his blood sugar was controlled, the procedure proceeded as scheduled. As a result, during the procedure, Bijan suffered a stroke and went into cardiac arrest on the procedure table with critical care doctors struggling to resuscitate him, according to the Van Wey, Metzler & Williams law firm, which represented the family.

As a result of the incident, Bijan sustained damage to his brain, an extended coma, and a host of severe medical problems. Bijan now suffers from cognitive and motor skill impairment and he will require a lifetime of medical care.

To hold Baylor Heart Hospital accountable, Bijan Pajouh and his family sought the assistance of Van Wey, Metzler & Williams. While they were seeking help to be able to cover Bijan’s medical care, their primary concern was making sure that what happened to Bijan never happens again to other patients undergoing routine, elective procedures at the Baylor Heart Hospital.

Even with the cards stacked against them, Kay Van Wey and Brady Williams took on the case. Over the course of an 8-day trial, they were able to show the jury that malpractice and unsafe hospital policies were what led to Bijan’s catastrophic outcome.
